None of the funds appropriated by this Act, prior Acts making appropriations for the Department of State, foreign operations, and related programs, or any other Act may be used to downsize, downgrade, consolidate, close, move, or relocate the Bureau of Population, Refugees, and Migration, Department of State, to another Federal agency. Funds made available by this Act— under the heading Migration and Refugee Assistance shall be administered by the Assistant Secretary for Population, Refugees, and Migration, Department of State, and this responsibility shall not be delegated; and that are made available for the Office of Global Women’s Issues shall be administered by the United States Ambassador-at-Large for Global Women’s Issues, Department of State, and this responsibility shall not be delegated.
None of the funds appropriated by this Act, prior Acts making appropriations for the Department of State, foreign operations, and related programs, or any other Act may be used to implement a reorganization plan for an agency, organization, or entity funded by this Act unless the appropriate congressional committees receive, not less than 60 days prior to the date of the implementation of such plan, a— comprehensive analysis of the short- and long-term costs associated with such reorganization, including for implementation, facilities and personnel, for the current fiscal year and subsequent fiscal years; and specific plan for implementing such reorganization, including realistic timelines and benchmarks.
Funds appropriated by this Act, prior Acts making appropriations for the Department of State, foreign operations, and related programs, or any other Act may not be used to implement a reorganization by the Department of State, United States Agency for International Development, any other Federal agency, or organization funded by this Act without prior consultation by the head of such department, agency, or organization with the appropriate congressional committees. Funds made available by this Act that are made available for the reorganization of the Department of State, USAID, or any other Federal agency, or organization funded by this Act shall be subject to the regular notification procedures of the Committees on Appropriations.
Operating plans submitted pursuant to section 7076(a) of this Act shall reflect, as applicable, the costs associated with any reorganization planned during fiscal year 2019. Funds appropriated by this Act and made available for the Department of State and USAID shall be made available to fund the full cost of the personnel requirements necessary to carry out the diplomatic, development, and national security missions of the Department of State and USAID: , That as of September 30, 2019 the on-board, full-time career/permanent personnel levels of the Foreign Service and Civil Service of— Provided the Department of State supported by such funds in title I of this Act under the heading Diplomatic Programs shall be not less than 12,900 and 8,400, respectively; and USAID supported by such funds in title II of this Act under the heading Operating Expenses shall not be less than 1,850 and 1,600, respectively.
For the purpose of this section, the term reorganization means any step taken to— expand, eliminate, consolidate, or downsize departments, agencies, or organizations, including bureaus and offices within or between such departments, agencies, or organizations, including the transfer to other agencies of the authorities and responsibilities of such bureaus and offices; and expand, eliminate, consolidate, or downsize the United States official presence overseas including at bilateral, regional, and multilateral diplomatic facilities and other platforms.
