None of the funds made available in this Act may be used by the Executive Office of the President to request— any official background investigation report on any individual from the Federal Bureau of Investigation; or a determination with respect to the treatment of an organization as described in section 501(c) of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code from the Department of the Treasury or the Internal Revenue Service. Subsection
(a)shall not apply— in the case of an official background investigation report, if such individual has given express written consent for such request not more than 6 months prior to the date of such request and during the same presidential administration; or if such request is required due to extraordinary circumstances involving national security.
