Sec. 5501. Ergonomic seating working group

Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation shall convene a working group to examine the seating standards for commercial drivers. At a minimum, the working group shall include— seat manufacturers; commercial vehicle manufacturers; transit vehicle manufacturers; labor representatives for the trucking industry; representatives from organizations engaged in collective bargaining on behalf of transit workers in not fewer than 3 States; and musculoskeletal health experts.
The Secretary shall pursue the following objectives through the working group: To identify health issues, including musculoskeletal health issues, that afflict commercial drivers due to sitting for long periods of time while on duty. To identify research topics for further development and best practices to improve seating. To determine ways to incorporate improved seating into manufacturing standards for public transit vehicles and commercial vehicles. Not later than 18 months after the date of enactment of this Act, the working group shall submit to the Secretary, the Committee on Transportation and Infrastructure of the House of Representatives, and the Committee on Banking, Housing, and Urban Affairs and the Committee on Commerce, Science, and Transportation of the Senate a report on the findings of the working group under this section and any recommendations for the adoption of better ergonomic seating for commercial drivers.
Upon receipt of the report in paragraph (1), the Secretary shall publish the report on a publicly accessible website of the Department. The Advisory Committee shall be subject to the Federal Advisory Committee Act (5 U.S.C. App.).
