Section 217 of title 23, United States Code, is amended— in subsection (d)— by striking 104(b)(3) and inserting 104(b)(4) ; and by striking a position and inserting at least one full-time positions ; in subsection
(e)by striking bicycles and inserting pedestrians or bicyclists each place such term appears; and in subsection
(j)by striking paragraph
(2)and inserting the following: The term electric bicycle means mean a bicycle equipped with fully operable pedals, a saddle or seat for the rider, and an electric motor of less than 750 watts that can safely share a bicycle transportation facility with other users of such facility and meets the requirements of one of the following three classes: The term class 1 electric bicycle means an electric bicycle equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the bicycle reaches the speed of 20 miles per hour. The term class 2 electric bicycle means an electric bicycle equipped with a motor that may be used exclusively to propel the bicycle, and that is not capable of providing assistance when the bicycle reaches the speed of 20 miles per hour. The term class 3 electric bicycle means an electric bicycle equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the bicycle reaches the speed of 28 miles per hour. .
