Section 5336 of title 49, United States Code, is amended— in subsection (b)— in paragraph (2)— in subparagraph (A)— in the matter preceding clause
(i)by striking 95.61 percent and inserting 95 percent ; in clause
(i)by striking 95.61 percent and inserting 95 percent ; and in clause
(ii)by striking 95.61 percent and inserting 95 percent ; and in subparagraph (B)— in the matter preceding clause
(i)by striking 4.39 percent and inserting 5 percent ; in clause (i)— by inserting in the highest 25 percent of routes by ridership before multiplied by ; and by striking vehicle passenger miles traveled for each dollar of operating cost in an area and inserting vehicles operating in peak revenue service per hour in the highest 25 percent of routes by ridership ; and in clause (ii)— by inserting in the highest 25 percent of routes by ridership before multiplied by ; and by striking vehicle passenger miles traveled for each dollar of operating cost in all areas and inserting vehicles operating in peak revenue service per hour in the highest 25 percent of routes by ridership ; and by adding at the end the following: For fiscal year 2022, the percentage— in paragraph (2)(A) in the matter preceding clause
(i)shall be treated as 100 percent; and in paragraph (2)(B) in the matter preceding clause
(i)shall be treated as 0 percent. ; in subsection (c)— in paragraph
(1)by striking 90.8 percent and inserting 90 percent each place it appears; in paragraph (2)— by striking 9.2 percent and inserting 8 percent ; by striking 200,000 and inserting 500,000 ; by striking subparagraph
(A)and inserting the following: the number of bus passenger miles traveled on the highest 25 percent of routes by ridership multiplied by the number of buses operating in peak revenue service per hour on the highest 25 percent of routes by ridership; divided by ; and by striking subparagraph
(B)and inserting the following: the total number of bus passenger miles traveled on the highest 25 percent of routes by ridership multiplied by the total number of buses operating in peak revenue service per hour on the highest 25 percent of routes by ridership in all areas. ; and by adding at the end the following: 2 percent of the total amount apportioned under this subsection shall be apportioned so that each urbanized area with a population of at least 200,000 and less than 500,000 is entitled to receive an amount using the formula in paragraph (1). For fiscal year 2022, the percentage— in paragraph
(1)in the matter preceding subparagraph
(A)shall be treated as 100 percent; in paragraph
(2)in the matter preceding subparagraph
(A)shall be treated as 0 percent; and in paragraph
(3)shall be treated as 0 percent. ; and by adding at the end the following: In this section, the term peak revenue service means the time period between the time that an agency exceeds the number of midday vehicles in revenue service per hour in the morning peak and the time that an agency falls below the number of midday vehicles in revenue service per hour in the evening peak. .
