Not later than 60 days after the date of enactment of this Act, the Architectural and Transportation Barriers Compliance Board established under section 502(a)(1) of the Rehabilitation Act of 1973 ( 29 U.S.C. 792 ), in consultation with the Secretary of Transportation, shall establish guidelines setting forth minimum standards for pedestrian facilities in the public right-of-way. The guidelines described in subsection
(a)shall be substantially similar to— the notice of proposed rulemaking published on July 26, 2011, titled Accessibility Guidelines for Pedestrian Facilities in the Public Right-of-Way (76 Fed. Reg. 44664); and the supplemental notice of proposed rulemaking published on February 13, 2013, titled Accessibility Guidelines for Pedestrian Facilities in the Public Right-of-Way; Shared Use Paths (78 Fed. Reg. 10110). Not later than 180 days after the establishment of the guidelines pursuant to subsection (a), the Secretary shall issue such regulations as are necessary to adopt such guidelines.
