For each of fiscal years 2022 through 2025, of the amounts apportioned to a State under paragraph
(1)of section 104(b) of title 23, United States Code, each State shall obligate amounts distributed to such State under subsection
(b)for projects and strategies that reduce vehicle-caused wildlife mortality related to, or to restore and maintain connectivity among terrestrial or aquatic habitats affected by, a transportation facility otherwise eligible for assistance under section 119 of title 23, United States Code. The total amount to be obligated by all States under paragraph
(1)shall equal $75,000,000 for each of fiscal years 2022 through 2025. Each State’s share of the amount described under subsection (a)(2) shall be determined by multiplying the amount described under such subsection by the ratio that— the amount apportioned in the previous fiscal year to the State under section 104 of title 23, United States Code; bears to the total amount of funds apportioned to all States in the previous fiscal year. A State may opt out of the obligation requirement described under this section if the Governor of the State notifies the Secretary that the State has inadequate needs to justify the expenditure not later than 30 days prior to apportionments being made for any fiscal year. A State that exercises the authority under paragraph
(1)may use the funds described under this section for any purpose described under section 119 of title 23, United States Code.
