Section 1311(c) of the Patient Protection and Affordable Care Act ( 42 U.S.C. 18031(c) ) is amended— in paragraph (6), by striking The Secretary and inserting Subject to paragraph (7), the Secretary ; and by adding at the end the following new paragraph: In the case of an Exchange operated by a State, beginning with plan year 2021, the Exchange may provide for open enrollment periods (after the initial enrollment period) every 12, 24, or 36 months, as determined by the State. .
