Amounts made available by this Act or any prior Act that the Secretary determines represent improper payments by the Department of Transportation to a third-party contractor under a financial assistance award, which are recovered pursuant to law, shall be available— to reimburse the actual expenses incurred by the Department of Transportation in recovering improper payments: , That amounts made available by this Act shall be available until expended; and Provided to pay contractors for services provided in recovering improper payments or contractor support in the implementation of the Improper Payments Information Act of 2002 ( Public Law 107–300 ), as amended by the Improper Payments Elimination and Recovery Act of 2010 ( Public Law 111–204 ) and Improper Payments Elimination and Recovery Improvement Act of 2012 ( Public Law 112–248 ), and Fraud Reduction and Data Analytics Act of 2015 ( Public Law 114–186 ): , That amounts in excess of that required for paragraphs
(1)and (2)— Provided shall be credited to and merged with the appropriation from which the improper payments were made, and shall be available for the purposes and period for which such appropriations are available: , That where specific project or accounting information associated with the improper payment or payments is not readily available, the Secretary may credit an appropriate account, which shall be available for the purposes and period associated with the account so credited; or Provided further if no such appropriation remains available, shall be deposited in the Treasury as miscellaneous receipts: , That prior to depositing such recovery in the Treasury, the Secretary shall notify the House and Senate Committees on Appropriations of the amount and reasons for such transfer: Provided further , That for purposes of this section, the term Provided further improper payments has the same meaning as that provided in section 2(e)(2) of the Improper Payments Elimination and Recovery Act of 2010 ( Public Law 111–204 ).
