Section 41 of the Mineral Leasing Act ( 30 U.S.C. 195 ) (as amended by section 14) is amended by adding at the end the following: The Director of the Bureau of Land Management may include in a notice of noncompliance issued to a person subject to the requirements of this Act an assessment of a civil penalty in accordance with paragraph (2). Subject to paragraph (3), a penalty assessed pursuant to paragraph
(1)shall not exceed $100,000 per incident per day. The Secretary may increase the maximum amount described in paragraph
(2)after notice and opportunity for public comment. .
