Funds are hereby authorized to be appropriated for fiscal years 2018 and 2019 for the conduct of the intelligence and intelligence-related activities of the following elements of the United States Government: The Office of the Director of National Intelligence. The Central Intelligence Agency. The Department of Defense. The Defense Intelligence Agency. The National Security Agency. The Department of the Army, the Department of the Navy, and the Department of the Air Force. The Coast Guard.
The Department of State. The Department of the Treasury. The Department of Energy. The Department of Justice. The Federal Bureau of Investigation. The Drug Enforcement Administration. The National Reconnaissance Office. The National Geospatial-Intelligence Agency. The Department of Homeland Security. Funds appropriated by the Department of Defense Missile Defeat and Defense Enhancements Appropriations Act, 2018 (division B of Public Law 115–96 ) for intelligence or intelligence-related activities are specifically authorized by Congress for purposes of section 504 of the National Security Act of 1947 ( 50 U.S.C. 3094 ), as specified in the classified Schedule of Authorizations pursuant to section 102, and are subject to such section 504.
Section 504 of the National Security Act of 1947 ( 50 U.S.C. 3094 ) is amended— by redesignating subsection
(e)as subsection (f); and by inserting after subsection
(d)the following: This section cannot be waived for any covert action (as defined in section 503(e)) unless and until the Director of National Intelligence notifies the congressional intelligence committees that the action is urgent for national security purposes. . Such section, as amended by paragraph (1), is further amended— by redesignating subsection
(f)as subsection (g); and by inserting after subsection (e), as added by paragraph (1), the following: This section cannot be waived for any major system (as defined in section 506A(e)) acquisition unless and until the Director of National Intelligence notifies the congressional intelligence committees that the action is urgent for national security purposes. .
