Not later than 180 days after the date of enactment of this Act, the Comptroller General of the United States shall— conduct an audit of the extraordinary maintenance repayment contracts No. 16XX630077 and No. 16XX630076 between the United States and the Bostwick Division for repairs to the Tainter gates and other features at Harlan County Dam, including— an examination of whether— the Corps of Engineers should have designated the Tainter gate rehabilitation as a Dam Safety Modification , subject to the cost-sharing requirements under section 1203 of the Water Resources Development Act of 1986 ( 33 U.S.C. 467n ), instead of an extraordinary maintenance project ; and a more appropriate cost share should have applied to the Bostwick Division; a review of— the amounts owed by the Bostwick Division to the Bureau of Reclamation; and any reimbursements owed by the Corps of Engineers to the Bureau of Reclamation based on the actual costs of the project after completion; and a review of project designations and cost-share policies of the Bureau of Reclamation and other Federal agencies for similar spillway gate repairs; and submit to Congress a report on the results of the audit under paragraph (1).
Payments made after the date of enactment of this Act by the Bostwick Division to the Bureau of Reclamation under the contracts described in subsection (a)(1) shall be— deposited into a no-year account; and disbursed to the Bureau of Reclamation upon submission of the report under subsection (a)(2).
