Part E of the Safe Drinking Water Act ( 42 U.S.C. 300j et seq.) is amended by adding at the end the following: In this section, the term intractable water system means a community water system or a noncommunity water system— that serves fewer than 1,000 individuals; and the owner or operator of which— is unable or unwilling to provide safe and adequate service to those individuals; has abandoned or effectively abandoned the community water system or noncommunity water system, as applicable; has defaulted on a financial obligation relating to the community water system or noncommunity water system, as applicable; fails to maintain the facilities of the community water system or noncommunity water system, as applicable, in a manner so as to prevent a potential public health hazard; or is in significant noncompliance with this Act or any regulation promulgated pursuant to this Act.
Not later than 2 years after the date of enactment of this section, the Administrator, in consultation with the Secretary of Agriculture and the Secretary of Health and Human Services, shall complete a study that— identifies intractable water systems; and describes barriers to delivery of potable water to individuals served by an intractable water system. Not later than 2 years after the date of enactment of this section, the Administrator shall submit to Congress a report describing findings and recommendations based on the study under this subsection.
Section 1414(h)(2) shall apply to any person carrying out a plan to address an intractable water system that is approved by— in the case of a State with primary enforcement responsibility under section 1413, the State; or in the case of a State that does not have primary enforcement responsibility, the Administrator. .
