The Secretary shall commence and complete the construction of roads along the southern border to facilitate safe and swift access for U.S. Customs and Border Protection personnel to access the border for purposes of patrol and apprehension. The roads constructed under paragraph
(1)shall include— access roads; border roads; patrol roads; and Federal, State, local, and privately-owned roads. The Secretary, in partnership with local stakeholders, shall maintain roads used for purposes of patrol and apprehension. The Secretary shall— develop policies and guidance for documenting agreements with landowners relating to the construction of roads under subsection (a), as the Secretary determines to be necessary; share the policies and guidance developed under paragraph
(1)with each Border Patrol Sector of U.S. Customs and Border Protection; document and communicate the process and criteria for prioritizing funding for operational roads not owned by the Federal Government; and assess the feasibility of options for addressing the maintenance of non-Federal public roads, including any data needs relating to such maintenance.
