Section 101(a)(8) ( 8 U.S.C. 1101(a)(8) ) is amended to read as follows: The term Department means the Department of Homeland Security. . Section 101(a)(15) ( 8 U.S.C. 1101(a)(15) ) is amended— in subparagraph (F)(i)— by striking the term Attorney General each place that term appears and inserting Secretary ; and by striking 214(l) and inserting 214(m) ; in subparagraph (H)(i)— in subclause (b), by striking certifies to the Attorney General that the intending employer has filed with the Secretary and inserting certifies to the Secretary of Homeland Security that the intending employer has filed with the Secretary of Labor ; and in subclause (c), by striking certifies to the Attorney General and inserting certifies to the Secretary of Homeland Security ; and in subparagraph (M)(i), by striking the term Attorney General each place that term appears and inserting Secretary .
Section 101(a)(18) ( 8 U.S.C. 1101(a)(18) ) is amended by striking Service or of the United States designated by the Attorney General, and inserting Department or of the United States designated by the Secretary, . Section 101(a)(34) ( 8 U.S.C. 1101(a)(34) ) is amended to read as follows: The term Secretary means the Secretary of Homeland Security, except as provided in section 219(d)(4). . Section 101(a)(27)(L)(iii) ( 8 U.S.C. 1101(a)(27)(L)(iii) ) is amended by adding ; or at the end.
Section 101(a)(44)(C) ( 8 U.S.C. 1101(a)(44)(C) ) is amended by striking Attorney General and inserting Secretary . Section 101(a)(47)(A) ( 8 U.S.C. 1101(a)(47)(A) ) is amended to read as follows: The term order of removal means the order of the immigration judge, or other such administrative officer to whom the Attorney General or the Secretary has delegated the responsibility for determining whether an alien is removable, concluding that the alien is removable or ordering removal. .
Section 101(b) ( 8 U.S.C. 1101(b) ) is amended— in paragraph (1)(F)(i), by striking Attorney General and inserting Secretary ; and in paragraph (4), by striking Immigration and Naturalization Service. and inserting Department. . Section 103 ( 8 U.S.C. 1103 ) is amended by striking the section heading and subsection (a)(1) and inserting the following: The Secretary shall be charged with the administration and enforcement of this Act and all other laws relating to the immigration and naturalization of aliens, except insofar as this Act or such laws relate to the powers, functions, and duties conferred upon the President, the Attorney General, the Secretary of Labor, the Secretary of Agriculture, the Secretary of Health and Human Services, the Commissioner of Social Security, the Secretary of State, the officers of the Department of State, or diplomatic or consular officers.
A determination and ruling by the Attorney General with respect to all questions of law shall be controlling. . (c)to read as follows: The Secretary shall be a citizen of the United States and shall be appointed by the President, by and with the advice and consent of the Senate. The Secretary shall be charged with any and all responsibilities and authority in the administration of the Department and of this Act. The Secretary may enter into cooperative agreements with State and local law enforcement agencies for the purpose of assisting in the enforcement of the immigration laws. ; in subsection (e)— in paragraph (1), by striking Commissioner and inserting Secretary ; and in paragraph (2), by striking Service and inserting U.S. Citizenship and Immigration Services ; in subsection (f)— by striking Attorney General and inserting Secretary ; by striking Immigration and Naturalization Service and inserting Department ; and by striking Service, and inserting Department, ; and in subsection (g)(1), by striking Immigration Reform, Accountability and Security Enhancement Act of 2002 and inserting Homeland Security Act of 2002 ( .
