Sections 482(c) and 492 of the Higher Education Act of 1965 ( 20 U.S.C. 1089(c) , 1098a) and section 553 of title 5, United States Code, shall not apply to this subtitle. Notwithstanding section 437 of the General Education Provisions Act ( 20 U.S.C. 1232 ) and section 553 of title 5, United States Code, the Secretary shall make publicly available, by notice in the Federal Register, the waivers, modifications, or extensions granted under this subtitle. The Secretary is not required to exercise any waiver or modification authority under this subtitle on a case-by-case basis.
