A person may file a petition for review of a final rule issued under this Act in the United States Court of Appeals for the District of Columbia Circuit. A petition shall be filed under this section not later than 120 days after the date on which the rule to be reviewed is published in the Federal Register. Notwithstanding paragraph (1), a petition that is based solely on grounds that arise after the deadline to file a petition under paragraph
(1)has passed may be filed not later than 120 days after the date on which such grounds first arise.
