In this Act: The terms elementary school , local educational agency , outlying areas , secondary school , and State educational agency have the meanings given the terms in section 8101 of the Elementary and Secondary Education Act of 1965 ( 20 U.S.C. 8101 ). The term ASHRAE Energy Standard for Buildings means American Society of Heating, Refrigerating and Air-Conditioning Engineers Standard 90.1.–2016 or any successor standard. The term charter school has the meaning given the term in section 4310 of the Elementary and Secondary Education Act of 1965 ( 20 U.S.C. 722li ).
The term CHPS Criteria means the green building rating criteria developed by the Collaborative for High Performance Schools. The term covered funds means funds provided under title I or title II. The term early learning facility means a public facility that— serves children who are not yet in kindergarten; and is under the jurisdiction of a local educational agency. The term Energy Star means the Energy Star program of the Department of Energy and the Environmental Protection Agency.
The term facility condition index means, as of the date of the calculation, the cost of maintenance, repairs, and replacement deficiencies of a facility, divided by the estimated replacement value of the facility. The term high-need local educational agency means a local educational agency that— serves a high percentage of high-need schools; and is among the local educational agencies in a State with the highest number or proportion of children who are counted under section 1124(c) of the Elementary and Secondary Education Act of 1965, in comparison to other local educational agencies in the State.
The term high-need school means— an elementary school or middle school in which not less than 50 percent of the enrolled students are children from low-income families; or a high school in which not less than 40 percent of the enrolled students are children from low-income families, which may be calculated using comparable data from the schools that feed into the high school. The term LEED Green Building Rating System means the United States Green Building Council Leadership in Energy and Environmental Design green building rating system.
The term low-income family means a family— in which the children are eligible for a free or reduced-price lunch under the Richard B. Russell National School Lunch Act ( 42 U.S.C. 1751 et seq.); receiving assistance under the program of block grants to States for temporary assistance for needy families established under part A of title IV of the Social Security Act ( 42 U.S.C. 601 et seq.); or in which the children are eligible to receive medical assistance under the Medicaid program under title XIX of the Social Security Act ( 42 U.S.C. 1396 et seq.).
The term public school facility means a public elementary school or secondary school facility, including a public charter school facility or an existing facility planned for adaptive reuse as a public charter school facility. The term rural local educational agency means a local educational agency that meets the eligibility requirements under— section 5211(b) of the Elementary and Secondary Education Act of 1965 ( 20 U.S.C. 7345(b) ) for participation in the program described in subpart 1 of part B of title V of such Act; or section 5221(b) of the Elementary and Secondary Education Act of 1965 ( 20 U.S.C. 7351(b) ) for participation in the program described in subpart 2 of part B of title V of such Act.
The term Secretary means the Secretary of Education. The term State means each of the several States of the United States, the District of Columbia, and the Commonwealth of Puerto Rico.
