During the transition period the FHA may— carry out any power or responsibility of the Secretary of the Housing and Urban Development relating to mortgage insurance programs under the National Housing Act that the Secretary delegates to the FHA, using the staff, systems, and administrative infrastructure that the FHA engages or acquires during the transition period, or the personnel and other resources of the Secretary; incur any obligation consistent with— the carrying out of a power or responsibility delegated under paragraph (1); or the acquisition, engagement, or development of staff, systems (including technology to enhance the ability of the FHA to engage in the business authorized by the title), and administrative structure; engage in any activity or undertake any responsibility (not including entering into, or making any commitment to enter into, any contract of insurance under this title) that the FHA determines to be consistent with the establishment of the FHA; and carry out any power or responsibility of the Secretary of Agriculture under title V of the Housing Act of 1949 that the Secretary delegates to the FHA, using the staff, systems, and administrative infrastructure that the FHA engages or acquires during the transition period, and the personnel and other resources of the Rural Housing Service.
