Subtitle C of title IV of the Homeland Security Act of 2002 ( 6 U.S.C. 231 et seq.), as amended by sections 1115, 1123, and 1126 of this division, is further amended by adding at the end the following new sections: Not later than 180 days after the date of the enactment of this section, the Secretary shall, to the greatest extent practicable, and in a risk based manner and on an individualized basis, review the social media accounts of certain visa applicants who are citizens of, or who reside in, high-risk countries, as determined by the Secretary based on the criteria described in subsection (b).
In determining whether a country is high-risk pursuant to subsection (a), the Secretary, in consultation with the Secretary of State, shall consider the following criteria: The number of nationals of the country who were identified in United States Government databases related to the identities of known or suspected terrorists during the previous year. The level of cooperation of the country with the counter-terrorism efforts of the United States. Any other criteria the Secretary determines appropriate.
To carry out the requirements of subsection (a), the Secretary may collaborate with— the head of a national laboratory within the Department’s laboratory network with relevant expertise; the head of a relevant university-based center within the Department’s centers of excellence network; and the heads of other appropriate Federal agencies. The Secretary, in collaboration with the Secretary of State, is authorized to waive the requirements of subsection
(a)as necessary to comply with international obligations of the United States. The Secretary shall, to the greatest extent practicable, and in a risk based manner, review open source information of visa applicants. . The table of contents in section 1(b) of the Homeland Security Act of 2002, as amended by this division is further amended by inserting after the item relating to section 437 the following new items: Sec. 438. Social media screening. Sec. 439. Open source screening. .
