Sec. 8203. Reauthorization of the Drug-Free Communities Program

Chapter 2 of the National Narcotics Leadership Act of 1988 ( 21 U.S.C. 1521 et seq.), except for subchapter II ( 21 U.S.C. 1541 et seq.), as in effect on September 29, 1997, and as amended by the laws described in paragraph (2), is revived and restored. The laws described in this paragraph are: Public Law 107–82 (115 Stat. 814). The Office of National Drug Control Policy Reauthorization Act of 2006 ( Public Law 109–469 : 120 Stat. 3502), as amended by paragraph (4). Section 1009 of the National Narcotics Leadership Act of 1988 ( 21 U.S.C. 1056 ) is amended by inserting and sections 1021 through 1035 after section 1007 .
Title VIII of the Office of National Drug Control Policy Reauthorization Act of 2006 ( Public Law 109–469 ; 120 Stat. 3535) is amended by striking Drug-Free Communities Act of 1997 each place it appears and inserting National Narcotics Leadership Act of 1988 . The amendments made by subparagraph
(A)shall take effect as though enacted as part of the Office of National Drug Control Policy Reauthorization Act of 2006 ( Public Law 109–469 ; 120 Stat. 3502). Chapter 2 of subtitle A of title I of the National Narcotics Leadership Act of 1988 ( 21 U.S.C. 1521 et seq.) is amended— in section 1022 ( 21 U.S.C. 1522 ), by striking substance abuse each place it appears and inserting substance use and misuse ; in section 1023 ( 21 U.S.C. 1523 ), by striking paragraph
(9)and inserting the following: The term substance use and misuse means— the illegal use or misuse of drugs, including substances for which a listing is effect under any of schedules I through V under section 202 of the Controlled Substances Act ( 21 U.S.C. 812 ); the misuse of inhalants or over-the-counter drugs; or the use of alcohol, tobacco, or other related product as such use is prohibited by State or local law. ; in section 1024 ( 21 U.S.C. 1524 ), by striking subsections
(a)and
(b)and inserting the following: There is authorized to be appropriated to the Office of National Drug Control Policy to carry out this chapter $99,000,000 for each of fiscal years 2018 through 2023. Not more than 8 percent of the funds appropriated to carry out this chapter may be used by the Office of National Drug Control Policy to pay administrative costs associated with the responsibilities of the Office under this chapter. ; in subchapter I ( 21 U.S.C. 1531 et seq.)— by striking substance abuse each place it appears and inserting substance use and misuse ; and in section 1032(b)(1)(A) ( 21 U.S.C. 1532(b)(1)(A) ), by striking clause
(iii)and inserting the following: Subject to clause (iv), the Administrator may award a renewal grant to a grant recipient under this subparagraph for each fiscal year of the 4-fiscal-year period following the first fiscal year for which the initial additional grant is awarded in an amount not to exceed the following: For the first and second fiscal years of the 4-fiscal-year period, the amount of the non-Federal funds, including in-kind contributions, raised by the coalition for the applicable fiscal year is not less than 125 percent of the amount awarded. For the third and fourth fiscal tears of the 4-fiscal-year period, the amount of the non-Federal funds, including in-kind contributions, raised by the coalition for the applicable fiscal year is not less than 150 percent of the amount awarded. ; and by striking subchapter II ( 21 U.S.C. 1541 et seq.).
