Sec. 1052. Department of Defense Review and Assessment on Advances, Opportunities, and Risks Related to Artificial Intelligence and Machine Learning

The Secretary of Defense, acting through the Defense Innovation Board and the Under Secretary of Defense for Research and Engineering, shall carry out a review and assessment of the advances in artificial intelligence, related machine learning developments, and associated technologies for military applications. In carrying out such review, the Secretary shall consider the methods and means necessary to advance the development of artificial intelligence, machine learning, and associated technologies within the Department of Defense to comprehensively address the national security needs and requirements of the Department of Defense. In conducting the review under paragraph
(a)the Secretary of Defense shall consider— the competitiveness of the Department of Defense in artificial intelligence, machine learning, and other associated technologies, including matters pertaining to public-private partnerships and investments; means and methods for the Department of Defense to maintain a technological advantage in artificial intelligence, machine learning, and other associated technologies, including quantum sciences, distributed ledger technologies, and high performance computing; means by which the Department of Defense can help foster greater emphasis and investments in basic and advanced research to stimulate private, public, academic, and combined initiatives in artificial intelligence, machine learning, and other associated technologies, including quantum sciences, distributed ledger technologies, and high performance computing; Department of Defense workforce and education initiatives to attract and recruit leading talent in artificial intelligence and machine learning, including science, technology, engineering, and math programs; means by which the Department of Defense may establish data standards and provide incentives for the sharing of open training data; and any other matters the Secretary of Defense determines relevant with respect to the approach of the Department of Defense to artificial intelligence and machine learning. Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense shall submit to the congressional defense committees an initial report on the findings of the review required under subsection
(a)and such recommendations as the Secretary may have for legislative action related to artificial intelligence, machine learning, and associated technologies, including recommendations to more effectively fund and organize the Department of Defense. Not later than one year after the date of the enactment of this Act, the Secretary of Defense shall submit to the congressional defense committees a comprehensive report on the review required under subsection (a). In this section, the term artificial intelligence includes each of the following: Any artificial system that performs tasks under varying and unpredictable circumstances without significant human oversight, or that can learn from experience and improve performance when exposed to data sets. An artificial system developed in computer software, physical hardware, or other context that solves tasks requiring human-like perception, cognition, planning, learning, communication, or physical action. An artificial system designed to think or act like a human, including cognitive architectures and neural networks. A set of techniques, including machine learning, that is designed to approximate a cognitive task. An artificial system designed to act rationally, including an intelligent software agent or embodied robot that achieves goals using perception, planning, reasoning, learning, communicating, decisionmaking, and acting.
