Sec. 1046. Program for Department of Defense controlled unclassified information in the hands of industry

The Secretary of Defense shall establish and implement a foreign ownership, control, or influence program for Department of Defense controlled unclassified information in the hands of industry. The Secretary may designate an entity or individual within the Department to take responsibility for such controlled unclassified information and the oversight of the program. Under the program required by subsection (a), the Secretary shall require that prior to any company receiving controlled unclassified information or classified information, or becoming a cleared defense contractor— the company shall report to the Secretary any foreign— direction or controlling interest of the company; or access to intellectual property relating to classified information or controlled unclassified information; and the Secretary shall determine if, on the basis of information reported under paragraph (1), the company should receive such information, including if risk to the national security can be mitigated and how such mitigation would be enforced.
