Section 1055 of the National Defense Authorization Act for Fiscal Year 2017 ( Public Law 114–328 ; 10 U.S.C. 113 note) is amended— in subsection (a)— in paragraph (1), by striking ; and and inserting a semicolon; in paragraph (2)(B), by striking the period at the end and inserting a semicolon; and by adding at the end the following new paragraphs: is requested by the non-Department of Defense Federal department or agency only after the department or agency has first reasonably attempted to use the resources of that department or agency to accomplish the mission for which the department or agency is making such request; and is most appropriately provided by the Department of Defense rather than another department or agency of the Federal Government. ; and in subsection (b), by adding at the end the following new paragraph:
The Secretary shall notify the congressional defense committees (and the congressional intelligence committees with respect to matters relating to members of the intelligence community) of requests made by the Secretary to a non-Department of Defense Federal department or agency for support that requires special protection from disclosure in the same manner and containing the same information as the Secretary notifies such committees of defense sensitive support requests under paragraphs
(1)and (3). .
