Sec. 124. Prohibition on availability of funds for Navy port waterborne security barriers

Except as provided under subsection (b), none of the funds authorized to be appropriated by this Act or otherwise made available for the Department of Defense for fiscal year 2019 may be used for the procurement of new Navy port waterborne security barriers. The Secretary of the Navy may waive the prohibition under subsection
(a)not less than 30 days after submitting to the congressional defense committees— a Navy requirements document that specifies Key Performance Parameters and Key System Attributes for new Navy port waterborne security barriers; a certification that the level of capability specified under paragraph
(1)will meet or exceed that of legacy Navy port waterborne security barriers; the acquisition strategy for the recapitalization of legacy Navy port waterborne security barriers, which will meet or exceed the requirements specified under paragraph (1); and a certification that any contract award or awards for new Navy port waterborne security barriers will result from full and open competition to the maximum extent practicable.
