Section 101(a)(5)(A) of the Marine Mammal Protection Act of 1972 ( 16 U.S.C. 1371(a)(5)(A) ) is amended— in clause (i), by striking Upon request and inserting Except as provided by clause (ii), upon request ; by redesignating clauses
(ii)and
(iii)as clauses
(iii)and (iv), respectively; and by inserting after clause
(i)the following new clause (ii): In the case of a military readiness activity (as defined in section 315(f) of the Bob Stump National Defense Authorization Act for Fiscal Year 2003 ( Public Law 107–314 ; 16 U.S.C. 703 note), clause
(i)shall be applied— in the matter preceding clause (I), by substituting seven consecutive years for five consecutive years ; and in clause (I), by substituting seven-year for five-year . .
