Sec. 1205. Review and report on processes and procedures used to carry out section 362 of title 10, United States Code

The Secretary of Defense, with the concurrence of the Secretary of State, shall conduct a review of the processes and procedures used to carry out section 362 of title 10, United States Code. Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense, with the concurrence of the Secretary of State, shall submit to the appropriate congressional committees a report that contains a summary and evaluation of the review required by subsection (a).
The report required by this subsection shall include the following: A description of the procedures used to obtain and verify information regarding the vetting of partner units for gross violation of human rights required under section 362 of title 10, United States Code, and to share such information with the Department of State. A description of the procedures used to conduct remediation of units determined or alleged to have committed gross violation of human rights, including a list of each unit completing such remediation since December 19, 2014.
An assessment of the procedures and associated timelines to implement the requirements of such section 362 on the Department of Defense’s ability to comply with such section 362 and achieve national security goals. A description of the processes and procedures used to implement section 1206 of the Carl Levin and Howard P. Buck McKeon National Defense Authorization Act for Fiscal Year 2015 ( Public Law 113–291 ; 128 Stat. 3538), including the process of obtaining the concurrence of the Secretary of State as required under subsection (c)(1) of such section.
Recommendations to revise authorities to improve the processes and procedures related to the vetting of foreign partner units for gross violations of human rights. Any other matters the Secretary considers appropriate. The report required by this subsection shall be submitted in unclassified form but may include a classified annex. In this subsection, the term appropriate congressional committees means— the congressional defense committees; and the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives.
Subsection (b)(3) of section 1206 of the Carl Levin and Howard P. Buck McKeon National Defense Authorization Act for Fiscal Year 2015 ( Public Law 113–291 ; 10 U.S.C. 2282 note) is amended by striking subsection
(b)of section 2249e of title 10, United States Code (as added by section 1204(a) of this Act) and inserting section 362(b) of title 10, United States Code .
