Section 101(a)(5)(A) of the Marine Mammal Protection Act of 1972 ( 16 U.S.C. 1371(a)(5)(A) ) is amended— in clause (i), by striking Upon request and inserting Except as provided by clause (ii), upon request ; by redesignating clauses
(ii)and
(iii)as clauses
(iii)and (iv), respectively; and by inserting after clause
(i)the following new clause (ii): In the case of a request described in clause
(i)made by the Department of Defense, such clause shall be applied— in the matter preceding clause (I), by substituting ten consecutive years for five consecutive years ; and in clause (I), by substituting ten-year for five-year . .
