Sec. 531. Definitions

In this subtitle: The term affected individual means an individual who has applied for or received student financial assistance under title IV of the Higher Education Act of 1965 ( 20 U.S.C. 1070 et seq.) and— who is an affected student; or whose primary place of employment or residency was— as of September 5, 2017, in a covered disaster area due to Hurricane Irma; or as of September 16, 2017, in a covered disaster area due to Hurricane Maria. The term affected institution means an institution of higher education that— is located in an area affected by a covered disaster; and has temporarily ceased operations as a consequence of a covered disaster, as determined by the Secretary.
In determining eligibility for assistance under this subtitle, the Secretary, using consistent, objective criteria, shall determine the time period for which an institution of higher education is an affected institution. An organizational unit of an affected institution that is not impacted by a covered disaster shall not be considered as part of such affected institution for purposes of receiving assistance under this subtitle. The term affected student means an individual who was enrolled or accepted for enrollment on— September 5, 2017, at an affected institution that closed due to Hurricane Irma; or September 16, 2017, at an affected institution that closed due to Hurricane Maria.
The term cancelled enrollment period means any period of enrollment at an affected institution during the academic year 2017–2018, during which students were unable to attend such institution. The term institution of higher education means— an institution covered by the definition of such term in section 101 of the Higher Education Act of 1965 ( 20 U.S.C. 1001 ); and an institution described in subparagraph
(A)or
(B)of section 102(a)(1) of such Act ( 20 U.S.C. 1002(a)(1)(A) , (B)). The term Secretary means the Secretary of Education.
