Section 241(b)(3) ( 8 U.S.C. 1231(b)(3) ) is amended— by adding at the end of subparagraph
(A)the following: The burden of proof shall be on the alien to establish that the alien's life or freedom would be threatened in that country, and that race, religion, nationality, membership in a particular social group, or political opinion would be at least one central reason for such threat. ; and in subparagraph (C), by striking In determining whether an alien has demonstrated that the alien's life or freedom would be threatened for a reason described in subparagraph (A), and inserting For purposes of this paragraph, . The amendments made by subsection
(a)shall take effect as if enacted on May 11, 2005, and shall apply to applications for withholding of removal made on or after such date.
