Section 40103(b) of title 49, United States Code, is amended— in paragraph
(1)by striking The Administrator each place it appears and inserting Before the date of transfer (as defined in section 90101(a)), the Administrator ; by striking paragraph
(2)and inserting the following: The Administrator shall— before the date of transfer (as defined in section 90101(a)), prescribe air traffic regulations on the flight of aircraft (including regulations on safe altitudes) for— navigating, protecting, and identifying aircraft; protecting individuals and property on the ground; using the navigable airspace efficiently; and preventing collisions between aircraft, between aircraft and land or water vehicles, and between aircraft and airborne objects; and on and after the date of transfer (as defined in section 90101(a)), prescribe safety regulations on the flight of aircraft (including regulations on safe altitudes) for— navigating, protecting, and identifying aircraft; protecting individuals and property on the ground; ensuring equitable access to and use of airspace; and preventing collisions between aircraft, between aircraft and land or water vehicles, and between aircraft and airborne objects. ; and in paragraph
(3)by striking Administrator each place it appears and inserting Secretary .
