Sec. 1040. Determination regarding transfer of defense articles to units committing gross violations of human rights

In carrying out the Golden Sentry program to monitor end-use compliance of the government of a foreign state to which defense articles and services have been provided, the Director of the Defense Security Cooperation Agency, in consultation with the appropriate United States embassy personnel in the foreign state, shall determine whether the government of the foreign state has transferred any defense article to a unit that is prohibited from receiving assistance from the United States by reason of a determination by the Secretary of State that there is credible evidence that such unit has committed a gross violation of human rights.
Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense shall submit to the Committee on Armed Services and the Committee on Foreign Relations of the Senate and the Committee on Armed Services and the Committee on Foreign Affairs of the House of Representatives a report on the implementation of subsection (a).
