Section 2376 of title 10, United States Code, is amended— in paragraph (1), by striking ; and commercial item , by adding at the end the following new paragraph: The term commercial item has the meaning given the term in section 103 of title 41, except that it does not include an item referred to in paragraph (3)(B) of such section if, after the minor modifications made to meet Federal Government requirements referred to in such paragraph, the item includes a preponderance of government-unique functions or essential characteristics. .
