Not later than 180 days after the date of the enactment of this Act and periodically thereafter as updates may require, the Secretary shall provide the National Crime Information Center of the Department of Justice with all information that the Secretary may possess regarding any alien against whom a final order of removal has been issued, any alien who has entered into a voluntary departure agreement, any alien who has violated the terms or conditions of the alien’s admission or parole into the United States or is unlawfully present in the United States (as defined in section 212(a)(9)(B)(ii) of the Immigration and Nationality Act ( 8 U.S.C. 1182(a)(9)(B)(ii) ) subject to the exceptions set forth in section 212(a)(9)(B)(iii) of the Act ( 8 U.S.C. 1182(a)(9)(B)(iii) )), and any alien whose visa has been revoked.
The National Crime Information Center shall enter such information into the Immigration Violators File of the National Crime Information Center database, regardless of whether— the alien has received notice of a final order of removal; the alien has already been removed; or sufficient identifying information is available with respect to the alien. Section 534(a) of title 28, United States Code, is amended— in paragraph (3), by striking and at the end; by redesignating paragraph
(4)as paragraph (5); and by inserting after paragraph
(3)the following: acquire, collect, classify, and preserve records of violations by aliens of the immigration laws (as defined in section 101(a)(17) of the Immigration and Nationality Act ( 8 U.S.C. 1101(a)(17) )), regardless of whether any such alien has received notice of the violations or whether sufficient identifying information is available with respect to any such alien or whether any such alien has already been removed from the United States; and . The Attorney General and the Secretary shall ensure that the amendment made by paragraph
(1)is implemented by not later than 6 months after the date of the enactment of this Act.
