Section 9 of the Food and Nutrition Act of 2008 ( 7 U.S.C. 2018 ) is amended— in subsection (a)(2)— in subparagraph
(A)by striking and at the end, in subparagraph
(B)by striking the period at the end and inserting ; and , and by adding at the end the following: parameters for retail food store cooperation with the Secretary sufficient to carry out subsection (i). . by adding at the end the following: To assist in making improvements to supplemental nutrition assistance program design, for each interval not greater than a 2-year period, the Secretary shall— collect a statistically significant sample of retail food store transaction data, including the cost and description of items purchased with supplemental nutrition assistance program benefits, to the extent practicable and without affecting retail food store document retention practices; and make a summarized report of aggregated data collected under subparagraph
(A)available to the public in a manner that prevents identification of individual retail food stores, individual retail food store chains, and individual members of households that use such benefits. Any transaction data that contains information specific to a retail food store, a retail food store location, a person, or other entity shall be exempt from the disclosure requirements of Section 552(a) of title 5 of the United States Code pursuant to section 552(b)(3)(B) of title 5 of the United States Code. The Secretary shall limit the use or disclosure of information obtained under this subsection in a manner consistent with sections 9(c) and 11(e)(8). .
