Section 1240A of the Food Security Act of 1985 ( 16 U.S.C. 3839aa–1 ) is amended— by redesignating paragraphs (1), (2), (3),
(4)and
(5)as paragraphs (2), (4), (5), (6), and (8), respectively; by inserting before paragraph
(2)(as so redesignated) the following: The term conservation planning assessment means a report, as determined by the Secretary, that— is developed by— a State or unit of local government (including a conservation district); a Federal agency; or a third-party provider certified under section 1242(e) (including a certified rangeland professional); assesses rangeland or cropland function and describes conservation activities to enhance the economic and ecological management of that land; and can be incorporated into a comprehensive planning document required by the Secretary for enrollment in a conservation program of the Department of Agriculture. ; in paragraph
(2)(as so redesignated), in subparagraph (B)(vi)— by inserting environmentally sensitive areas, after marshes, ; and by inserting identified or expected before resource concerns ; by inserting after paragraph
(2)(as so redesignated) the following: The term incentive practice means a practice or set of practices approved by the Secretary that, when implemented and maintained on eligible land, address 1 or more priority resource concerns. ; in paragraph
(6)(as so redesignated)— in subparagraph (A)— in clause (iv), by striking and at the end; by redesignating clause
(v)as clause (vii); and by inserting after clause
(iv)the following: soil testing; soil remediation to be carried out by the producer; and ; and in subparagraph (B)— in clause (i), by striking and at the end; by redesignating clause
(ii)as clause (vi); and by inserting after clause
(i)the following: planning for resource-conserving crop rotations (as defined in section 1240L(d)(1)); soil health planning, including increasing soil organic matter and the use of cover crops; a conservation planning assessment; precision conservation management planning; and ; by inserting after paragraph
(6)(as so redesignated) the following: The term priority resource concern means a natural resource concern or problem, as determined by the Secretary, that— is identified at the national, State, or local level as a priority for a particular area of a State; and represents a significant concern in a State or region. ; and by adding at the end the following: The term soil remediation means scientifically based practices that— ensure the safety of producers from contaminants in soil; limit contaminants in soil from entering agricultural products for human or animal consumption; and regenerate and sustain the soil. The term soil testing means the evaluation of soil health, including testing for— the optimal level of constituents in the soil, such as organic matter, nutrients, and the potential presence of soil contaminants, including heavy metals, volatile organic compounds, polycyclic aromatic hydrocarbons, or other contaminants; and the biological and physical characteristics indicative of proper soil functioning. .
