Sec. 362. Bringing the Federal Housing Finance Agency into the appropriations process

Section 1316 of the Housing and Community Development Act of 1992 ( 12 U.S.C. 4516 ) is amended— by amending subsection
(a)to read as follows: The Agency shall collect assessments and other fees that are designed to recover the costs to the Government of the annual appropriation to the Agency by Congress. Assessments and other fees described under paragraph
(1)for any fiscal year— shall be deposited and credited as offsetting collections to the account providing appropriations to the Agency; and except as provided in paragraph (3), shall not be collected for any fiscal year except to the extent provided in advance in appropriation Acts. If on the first day of a fiscal year an appropriation to the Agency has not been enacted, the Agency shall continue to collect (as offsetting collections) the assessments and other fees described under paragraph
(1)at the rate in effect during the preceding fiscal year, until 60 days after the date such an appropriation is enacted. ; and by striking subsection (f). The amendments made by this section shall apply with respect to expenses paid and assessments and other fees collected on or after the date that is 90 days after the date of the enactment of the first appropriation Act that provides for appropriations to the Federal Housing Finance Agency and that is enacted after the date of the enactment of this Act.
