Section 7 of the Toxic Substances Control Act ( 15 U.S.C. 2606 ) is amended— by striking subsection
(a)and inserting the following: The Administrator may commence a civil action in an appropriate United States district court for— seizure of an imminently hazardous chemical substance or mixture or any article containing the chemical substance or mixture; relief (as authorized by subsection (b)) against any person that manufactures, processes, distributes in commerce, uses, or disposes of, an imminently hazardous chemical substance or mixture or any article containing the chemical substance or mixture; or both seizure described in subparagraph
(A)and relief described in subparagraph (B). A civil action may be commenced under this paragraph, notwithstanding— the existence of— a decision by the Administrator under section 4A, 5(d)(3), or 6(c)(1); or a rule, testing consent agreement, or order under section 4, 5(d)(4), 6(d), or 6(h); or the pendency of any administrative or judicial proceeding under any provision of this Act. ; in subsection (d), by striking section 6(a) and inserting section 6(c) ; and in subsection (f), in the first sentence, by striking and unreasonable .
