The Bill Emerson Good Samaritan Food Donation Act ( 42 U.S.C. 1791 ) is amended— in subsection (b)— in paragraphs
(1)and (2), by striking Federal, State, and local each place it appears and inserting Federal and State ; in paragraph (3), by striking user is and inserting the following: “user— in the case of food, is charged a reduced rate for the food; or is ; and by adding at the end the following: The term ultimate distribution means any method by which an individual receives a product from an entity, including by donation or at a reduced cost. ; in subsection (c)(1)— by inserting (including a food or apparently fit grocery product the quality date (as defined in section 403 of the before Food Recovery Act of 2016 ) of which is expired) that the person ; and by striking good faith to and inserting the following: “good faith— directly to a needy individual; or to ; in subsection (e)— in the matter preceding paragraph (1), by striking Federal, State, and local and inserting Federal and State ; and in paragraph (2), by striking distribution and inserting ultimate distribution to needy individuals ; in subsection (f), by striking or local ; by redesignating subsection
(f)as subsection (g); and by inserting after subsection
(e)the following: The Secretary of Agriculture shall carry out this section, including through the issuance of regulations. .
