None of the funds appropriated by this or previous appropriations Acts may be used to establish a Chemical, Biological, Radiological, Nuclear, and Explosives Office until such time as the Congress has authorized such establishment. Subject to the limitation in subsection
(a)and notwithstanding section 503 of this Act, the Secretary may transfer funds for the purpose of executing authorization of the Chemical, Biological, Radiological, Nuclear, and Explosives Office. Not later than 15 days before transferring funds pursuant to subsection (b), the Secretary of Homeland Security shall submit a report to the Committees on Appropriations of the Senate and the House of Representatives, the Committee on Homeland Security and Governmental Affairs of the Senate, and the Committee on Homeland Security of the House of Representatives on— the transition plan for the establishment of the office; and the funds and positions to be transferred by source.
