Section 2377 of title 10, United States Code, is amended by adding at the end the following new subsection: The Defense Supplement to the Federal Acquisition Regulation shall include, for acquisitions of commercial items— a requirement that firm fixed-price, fixed-price incentive, fixed-price with economic price adjustment, and other fixed-price type contracts be used to the maximum extent practicable; and a prohibition on use of cost-type contracts. .
