Section 5343 of title 5, United States Code, is amended by adding at the end the following: The head of an agency may appoint an individual to a position in accordance with regulations prescribed under paragraph
(2)at such a rate of basic pay above the minimum rate of the appropriate grade as the Office of Personnel Management may authorize. The Office of Personnel Management may prescribe regulations that authorize the head of an agency to exercise the authority under paragraph
(1)in the case of— an unusually large shortage of qualified candidates for employment; unique qualifications of a candidate for employment; or a special need of the Government for the services of a candidate for employment. .
