The regulations to implement the executive orders and presidential memoranda listed in paragraph
(2)shall not apply to the purchases by the Department of Defense of commercially available off-the-shelf items. The executive orders and presidential memoranda referenced in paragraph
(1)are as follows: Executive Order 13706: Establishing Paid Sick Leave for Federal Contractors (9/7/2015). Executive Order 13673: Fair Pay and Safe Workplaces (7/31/2014). Executive Order 13568: Minimum Wage for Contractors (2/12/2014). Executive Order 13655: Non-Retaliation for Disclosure of Compensation Information (4/8/2014). Presidential Memorandum: Advancing Pay Equality Through Compensation Data Collection (4/8/2014). Presidential Memorandum: Updating and Modernizing Overtime Regulations (3/13/2014). Memorandum for the Heads of Executive Departments and Agencies on Contractor Tax Delinquency (1/20/2010). Executive Order 13495: Nondisplacement of Qualified Workers Under Service Contracts (1/30/2009). Executive Order 13494: Economy in Government Contracting (1/30/2009). Executive Order 13496: Notification of Employee Rights Under Federal Labor Laws (1/30/2009). Executive Order 13514: Focused on Federal Leadership in Environmental, Energy, and Economic Performance (10/5/2009). Executive Order 13502 — Use of Project Labor Agreements for Federal Construction Projects. The Secretary of Defense may waive any of the regulations to implement the executive orders and presidential memoranda listed in subsection
(a)for the purchases of other items by the Department of Defense.
