Sec. 703. Eligibility of certain beneficiaries under the TRICARE program for participation in the Federal Employees Dental and Vision Insurance Program

Section 8951 of title 5, United States Code, is amended— in paragraph (3), by striking paragraph
(1)or
(2)and inserting paragraph (1), (2), or
(8); and by adding at the end the following new paragraph: The term covered TRICARE-eligible individual means an individual entitled to dental care under chapter 55 of title 10, pursuant to section 1076c of such title, who the Secretary of Defense determines should be an eligible individual for purposes of this chapter. . Section 8981 of title 5, United States Code, is amended— in paragraph (3), by striking paragraph
(1)or
(2)and inserting paragraph (1), (2), or
(8); and by adding at the end the following new paragraph: The term covered TRICARE-eligible individual — means an individual entitled to medical care under chapter 55 of title 10, pursuant to section 1076d, 1076e, 1079(a), 1086(c), or 1086(d) of such title, who the Secretary of Defense determines in accordance with an agreement entered into under subparagraph
(B)should be an eligible individual for purposes of this chapter; and does not include an individual covered under section 1110b of title 10. The Secretary of Defense shall enter into an agreement with the Director of the Office of Personnel Management relating to classes of individuals described in subparagraph (A)(i) who should be eligible individuals for purposes of this chapter. . Section 8958(c) of title 5, United States Code, is amended— in paragraph (1), by striking or at the end; in paragraph (2), by striking the period at the end and inserting ; or ; and by adding at the end the following new paragraphs: in the case of a covered TRICARE-eligible individual who receives pay from the Federal Government or an annuity from the Federal Government due to the death of a member of the uniformed services (as defined in section 101 of title 10), and is not a former spouse of a member of the uniformed services, be withheld from— the pay (including retired pay) of such individual; or the annuity paid to such individual; and in the case of a covered TRICARE-eligible individual who is not described in paragraph (3), be billed to such individual directly. . Section 8988(c) of title 5, United States Code, is amended— in paragraph (1), by striking or at the end; in paragraph (2), by striking the period at the end and inserting ; or ; and by adding at the end the following new paragraphs: in the case of a covered TRICARE-eligible individual who receives pay from the Federal Government or an annuity from the Federal Government due to the death of a member of the uniformed services (as defined in section 101 of title 10), and is not a former spouse of a member of the uniformed services, be withheld from— the pay (including retired pay) of such individual; or the annuity paid to such individual; and in the case of a covered TRICARE-eligible individual who is not described in paragraph (3), be billed to such individual directly. . Subsection
(a)of section 1076c of title 10, United States Code, is amended to read as follows: The Secretary of Defense shall establish a dental insurance plan for retirees of the uniformed services, certain unremarried surviving spouses, and dependents in accordance with this section. The Secretary may satisfy the requirement under paragraph
(1)by entering into an agreement with the Director of the Office of Personnel Management to allow persons described in subsection
(b)to enroll in an insurance plan under chapter 89A of title 5 that provides benefits similar to those benefits required to be provided under subsection (d). .
