Sec. 838. Counting of major defense acquisition program subcontracts toward small business goals

Chapter 137 of title 10, United States Code, is amended by adding at the end the following new section: First tier and second tier subcontracts awarded by the Department of Defense under major defense acquisition programs to small business concerns, small businesses concerns owned and controlled by service-disabled veterans, qualified HUBZone small business concerns, small business concerns owned and controlled by socially and economically disadvantaged individuals, and small business concerns owned and controlled by women shall be considered toward annual Department of Defense management goals for procurement contracts awarded to those concerns.
In this section— the terms qualified HUBZone small business concern , small business concern , small business concern owned and controlled by service-disabled veterans , and small business concern owned and controlled by women have the meanings given those terms in section 3 of the Small Business Act ( 15 U.S.C. 632 ); and the term small business concern owned and controlled by socially and economically disadvantaged individuals has the meaning given the term in section 8(d)(3)(C) of the Small Business Act ( 15 U.S.C. 637(d)(3)(C) ). .
The table of sections at the beginning of such chapter is amended by adding at the end the following new item: 2338. Counting of major defense acquisition program subcontracts toward small business goals. .
