Sec. 827. Preference for fixed-price contracts

Not later than 180 days after the date of the enactment of this Act, the Defense Federal Acquisition Regulation Supplement shall be revised to establish a preference for fixed-price contracts, including fixed-price incentive fee contracts, in the determination of contract type. A contracting officer of the Department of Defense may not enter into a cost-type contract described in paragraph
(2)unless the contract is approved by— the Service Acquisition Executive, in the case of a contract entered into by a military service; or the Under Secretary of Defense for Acquisition, Technology, and Logistics, in the case of a Defense Agency contract. A contract described in this paragraph is— a cost-type contract in excess of $50,000,000, in the case of a contract entered into after the date that is 180 days after the date of the enactment of this Act and before October 1, 2018; a cost-type contract in excess of $20,000,000, in the case of a contract entered into on or after October 1, 2018, and before October 1, 2019; and a cost-type contract in excess of $5,000,000, in the case of a contract entered into on or after October 1, 2019.
