Sec. 1112. Limitation on number of SES employees

In this section: The term covered SES employee means an employee of the Department of Defense— who is serving in a Senior Executive Service position, as defined under section 3132(a)(2) of title 5, United States Code; and subject to paragraph (2), who is not serving in such position under an appointment as a highly qualified expert under section 9903 of title 5, United States Code. Not more than 200 employees may be excluded under paragraph (1)(B) for purposes of determining the number of covered SES employees.
On and after January 1, 2019, the number of covered SES employees may not exceed the number equal to the product obtained by multiplying— number of covered SES employees on December 31, 2015; and 0.75.
