Notwithstanding section 5(d) of the Every Student Succeeds Act ( Public Law 114–95 ; 129 Stat. 1806), the amendment made by section 7004(1) of such Act ( Public Law 114–95 ; 129 Stat. 2077)— for fiscal year 2016, shall— be applied as if amending section 8003(a)(5)(A) of the Elementary and Secondary Education Act of 1965, as in effect on the day before the date of enactment of the Every Student Succeeds Act ( Public Law 114–95 ; 129 Stat. 1802); and be in effect with respect to appropriations for use under title VIII of the Elementary and Secondary Education Act of 1965, as in effect on the day before the date of enactment of the Every Student Succeeds Act; and for fiscal year 2017 and each succeeding fiscal year, shall be in effect with respect to appropriations for use under title VII of the Elementary and Secondary Education Act of 1965, as amended by the Every Student Succeeds Act ( Public Law 114–95 ; 129 Stat. 1802).
