Section 2(h)(7)(C) of the Commodity Exchange Act ( 7 U.S.C. 2(h)(7)(C) ) is amended by adding at the end the following: Not later than 90 days after the date of enactment of this clause, the Commission shall promulgate regulations to define the term predominantly engaged for purposes of clause (i)(VIII). Regulations under this clause shall provide that an entity will not be considered to be predominantly engaged in activities that are in the business of banking or financial in nature if the consolidated revenues of the entity derived from such activities constitute less than 85 percent of the total consolidated revenues of the entity.
For purposes of subclause (II), in determining the percentage of the revenues of an entity that are derived from activities that are in the business of banking or financial in nature, all revenues that are, or result from, transactions used to hedge or mitigate commercial risk shall be excluded. .
