Sec. 2803. Limited exceptions to restriction on development of public infrastructure in connection with realignment of Marine Corps forces in Asia-Pacific region

Notwithstanding section 2821(b) of the Military Construction Authorization Act for Fiscal Year 2015 (division B of Public Law 113–291 ; 128 Stat. 3701; 10 U.S.C. 2687 note), the Secretary of Defense may proceed with a public infrastructure project on Guam described in subsection
(b)if— the project was identified in the report prepared by the Secretary Of Defense under section 2822(d)(2) of the Military Construction Authorization Act For Fiscal Year 2014 (division B of Public Law 113–66 ; 127 Stat. 1017); and amounts have been appropriated or made available to be expended by the Department of Defense for the project. Subsection
(a)applies to the following projects: A project intended to improve water and wastewater systems. A project intended to improve curation of archeological and cultural artifacts. A project intended to improve the control and containment of public health threats. Section 2821 of the Military Construction Authorization Act for Fiscal Year 2016 (division B of Public Law 114–92 ; 129 Stat. XXXX) is repealed.
